Terms of Service

Effective August 29, 2026

These Terms of Service govern your access to and use of Simmer. Please read them carefully before using the app or related services.

1. Eligibility and accounts

You must be at least 13 years old to use Simmer. If the law where you live requires a higher minimum age for online services, that higher age applies. If you are under the age of legal majority where you live, you represent that you have any consent required from a parent or legal guardian.

You are responsible for providing accurate account information, keeping your login credentials secure, and for activity that occurs through your account. Do not impersonate another person or create an account for deceptive or abusive purposes.

2. What Simmer provides

Simmer is a social cooking service where people can discover, save, create, and share recipes and cooking experiences, interact with other users, and use related community features. Features may change, be added, or be removed as the service evolves.

Recipes and other user content are provided for general informational and community purposes. Simmer does not guarantee that a recipe is accurate, safe, nutritionally appropriate, allergy-safe, or suitable for any particular person. Use your judgment and follow appropriate food-safety practices.

3. Your content

You retain ownership of content you create and submit to Simmer. By submitting content, you give Simmer a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, and otherwise process that content as reasonably necessary to operate, provide, improve, and promote the Simmer service. This license ends when your content is deleted from our systems, except to the extent continued storage or use is reasonably necessary for backups, legal obligations, safety, or content that others have independently copied or shared.

You represent that you have the rights necessary to submit your content and grant this license. You may not upload content that infringes someone else's copyright, trademark, privacy, publicity, or other rights.

4. Community rules

You must follow our Community Guidelines. Among other things, you may not use Simmer to post or send unlawful, threatening, hateful, sexually exploitative, harassing, deceptive, privacy-invasive, infringing, or otherwise prohibited material.

You may not misuse reporting, blocking, messaging, or other safety features, attempt to evade enforcement, interfere with the service, access another person's account without permission, scrape or automate access in a way we have not authorized, distribute malware, or use Simmer for spam or fraud.

5. Moderation, reports, and enforcement

We may use automated systems and human review to help detect, review, restrict, or remove content or accounts that may violate these Terms, our Community Guidelines, law, or the safety and integrity of Simmer. Users can report content and block other users through available in-app tools.

We may take action including warning users, limiting features, removing content, suspending or terminating accounts, preserving relevant records, or reporting matters to appropriate authorities where reasonably necessary. We are not obligated to host any particular content.

6. Intellectual property

Simmer's software, visual design, branding, logos, and other materials provided by Simmer, excluding user content, are owned by or licensed to Simmer and are protected by applicable intellectual-property laws. These Terms do not give you ownership of Simmer's intellectual property.

If you believe content on Simmer infringes your intellectual-property rights, contact support@simmercooks.com with enough information for us to understand and review the claim.

7. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect information. By using Simmer, you acknowledge the data practices described there.

8. Account deletion and termination

You may stop using Simmer at any time and may initiate account deletion using the account-deletion controls available in the app. We may suspend or terminate access when we reasonably believe an account violates these Terms, creates risk or harm, or must be restricted to comply with law.

Provisions that by their nature should survive termination, including provisions concerning ownership, licenses already exercised, disclaimers, limitations of liability, and disputes, will survive as permitted by law.

9. Third-party services and links

Simmer relies on third-party infrastructure and may contain links or integrations involving services we do not control. Those services may have their own terms and privacy practices. Simmer is not responsible for third-party services to the extent permitted by law.

10. Disclaimers

To the fullest extent permitted by law, Simmer is provided on an "as is" and "as available" basis. We do not promise that the service will always be available, uninterrupted, error-free, secure, or that user content will be accurate or reliable.

Nothing in Simmer is intended as medical, nutritional, dietary, or other professional advice. If you have allergies, dietary restrictions, medical conditions, or food-safety concerns, consult an appropriate qualified professional and independently verify ingredients and preparation methods.

11. Limitation of liability

To the fullest extent permitted by applicable law, Simmer and its operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or relating to your use of the service.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot legally be excluded.

12. Changes to Simmer or these Terms

We may update the service and these Terms as Simmer evolves. If we make material changes, we may provide notice as required by law. Your continued use of Simmer after updated Terms take effect means you accept the updated Terms, to the extent permitted by law.

13. Governing law

Except where the law where you live requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Nothing in this section limits consumer rights that cannot be waived under applicable law.
